I’m a commercial fisherman fighting the Royal Bank of Canada (RBC Bank) over a $100,000 loan mistake. I lost my home, fishing vessel and equipment. Help me fight this corporate bully by closing your RBC account.

There is no monthly interest payment date on the contract.
Date of first installment payment, (Principal + interest) is approximately 1 year from the signing of my contract.
Demand loan contracts signed by other fishermen around the same time showed a monthly interest payment date on their contract,(agreement).
The lending policy did change at RBC from one payment (principal + interest) per year for fishing loans to principal paid yearly with interest paid monthly. This lending practice was in place when I approached RBC.
Only problem is the loans officer was a replacement who wasn’t familiar with these type of loans. She never informed me verbally or in writing about this new criteria.

. . .i’ve had horrendous problems with canadian banks and brokerages (td bank financial group, bmo financial group, rbc financial group, cibc). they operate like BANDITS plain and simple. like CROOKS and we’re surrounded by them. you go shopping in the downtown of any city or town and you’re looking at these bastions of canadian CORRUPTION on every corner. canada is completely INFESTED with these pirates. hell, i can barely stand shopping at safeway for the sickening stench of bank of montreal, lost over a million bucks to bmo (bmo’s a safeway business partner).
AND when you do get blindsided by canadian bank blockheads and you attempt to access the dispute resolution and regulatory processes you discover the regulators are there to protect the financial services industry. the regulators are in place to shield crooked bankers from accountability. . .

You are absolutely right. The system is rotten to the core. The Royal Bank of Canada (RBC Bank) picked the wrong people to screw. I will continue to protest against RBC until they admit fault.
I’ve had my account with CIBC for 23 yrs, and am quite happy with the service I get from them.
The only thing that I don’t like them for, is investing options… they refuse to release the information in regards to mutual funds and their various performance until you have chosen one & put money into it. BMO on the other hand, will show you the portfolios of all of them ‘summarized’ and their performance for the last 10 yrs or more, and let you use that to decide. Their GIC’s they also don’t give you a quarterly, or annual report on how those are doing. I mistakenly put $500 into a Mixed Market GIC and now don’t have a clue what’s happening with it one month to the next, and won’t find out until 2012, much to my dismay.
Personally I use Investors Group for my investing options, but for day to day banking, I find CIBC is fine.
I’ve heard though that other major banks out there, if you go to them for change (rolls of coins) that they now charge you for them… not just “$20 for $20” but they actually charge you above what you’re getting, and I know CIBC doesn’t do that when I go there, needing change.
. . .the establishment in canada - the government, the lawyers and the banks - are waging a FRAUD JIHAD against the little guy, average people like you and me who are unable to fight back. it seems the financial services industry is so accustomed to foreclosing on people confiscation is in their blood, seizing assets is instinctual to them. it’s seize first, ask questions never, lie and deny when caught. i received a letter from the rbc financial group ombudsman, w.l. knight, re the seizure of my bank account that was replete with lie after lie after lie. bank policy is lie, lie, lie. get this: the rbc ombudsman even lied about the date when the letter was remitted to me! lied about the date!!! i’ve written an assessment of the “investigation” (there was no investigation) the rbc ombudsman supposedly conducted into the grievance i filed with the ombudsman office that i’ll post on my site soon. it’s appalling. . .
I had my so called investigation processed by RBC Ombudsman Wendy Knight. So many lies and twists in her investigation. She must have been hand picked for this job.
Wendy Knight (corporate puppet) should realize that maybe her boot licking (under the disguise of her RBC job) will affect her family some day.
The hypocrisy is totally sickening from the Royal Bank of Canada.
The bottom line is profit before people.

Bank protest a public issue
Recently I posted signs up all across Nova Scotia condemning
a large financial institution. The signs state:
$100,000 Mistake on Fishermen’s Loan. The public issue
here rests solely with the investigation process by the
banking industry.
The first investigation was done by the ombudsman for
this financial institution; the ombudsman sided with the
bank.
The next step was the Ombudsman for Banking Services
and Investments, which is the last level in Canada
for complaints against any financial institution. This
office agreed with the earlier decision. The loans officer
who processed my loan was never questioned by either
office during this whole investigation.
The first investigation was processed by a person paid
by the bank, and the OBSI is funded by all the chartered
banks across Canada. Any investigation done for a client
of a bank should be resolved by a independent, arm’slength
board funded by the government to ensure proper
transparency and fairness.
I came to the conclusion that not only did this financial
institution fail me but the whole investigation into this
fishermen’s loan showed absolute bias. I contend that this
financial giant arbitrarily destroyed my business and
credit without properly giving me due process.
I will fight this corporate bully publicly with steadfast
resolve until I receive a fair investigation. I speak for all
concerned clients of the Canadian banking system
because when loan mistakes happen they will face similar
injustice, manufactured to benefit the banking establishment.

You are right on the nail. I’m still waiting for the Nova Scotia Police Review Board decision. This cop was under 3 internal investigations before this incident. He has a family member working at that RBC branch. I’m allowed to protest on any sidewalk in Canada. My conditions stated that I was to refrain from contacting any RBC employee past or present by telephone or email and to stay away from all RBC property.

against regional police
SYDNEY - A 47-year-old New Waterford
man who has had a long-standing
feud with the Royal Bank of Canada
has filed a formal complaint
against Cape Breton Regional Police
who arrested him for protesting at
one of the bank’s local branches.
Paul Fraser of Hudson Street, is
charged with two counts of breaching
a peace bond and a single count of
resisting arrest after police arrested
him April 4 in Sydney. He is alleged to
have breached a peace bond, which
expires Saturday, by protesting near a
Royal Bank outlet.
Fraser contends that during his
arrest, officers used excessive force
resulting in injuries to his hand, arm
and shoulder. He has filed a complaint
with the police under provisions
of the Nova Scotia Police Act.
Chief Dave Wilson said an officer
has been assigned to investigate the
complaint noting the officer has 60
days in which to file a final report
which can offer such recommendations
as no action be taken or the officers
be disciplined. The report is not
made public by the police.
Once the report is filed, Fraser has
the option of accepting its findings or
filing an appeal with the Nova Scotia
Police Review Board.
For the past several years, Fraser
has been under court order to stay
away from branches of the bank in
Atlantic Canada after numerous
protests at outlets across the region
Fraser alleges the bank improperly
seized his fishing boat to repay a bank
loan. The bank contends Fraser
defaulted on his payments and that his
boat was seized as collateral.

We all must understand that banks are not our friends. If they can screw you, they will.
All the time dealing with them we must be super conscious of what we sign.
Never trust what they say, always read the fine print.
. . .when it comes to protecting the customer from fraud and misconduct banks pay LIP SERVICE to their clients only. a couple of years ago i opened an account at the powell river, bc branch of cibc and for some unknown reason cibc declared that any cheque i deposit would be subject to a five-day hold before i can access the cash. ANY CHEQUE! even a government issued cheque! nonetheless i agreed to cibc’s terms and opened the account. those are your terms? okay, i consent to them, where do i sign? so i deposit five hundred bucks CASH into my account through an atm. a couple days later i transfered the cash to another account. the transfer was APPROVED AND PROCESSED by the bank. CIBC PROCESSED THE TRANSFER OF FUNDS. the day after that cibc CANCELLED the cash transfer and hit me with a $35 insufficient funds charge. i went into the branch to find out what was going on. guess what the teller says? we put a five-day hold on your five hundred dollar deposit till it clears. BUT I DEPOSITED CASH!!! i said to the teller. YOU HAVE TO WAIT FOR CASH TO CLEAR??? oh. they gave me access to the cash but i still got hit with the thirty-five dollar nsf charge. . .
. . .when you open an account there seems to be an automatic assumption that the bank needs to protect itself from YOU. however, it’s the customer who needs protection from the rotten financial services industry of canada. . .
. . .and in another cibc anecdote, about fifteen years ago i opened an account at a white rock, bc branch of cibc. everything’s fine till i noticed incidents of withdrawals occurring from the account and they weren’t being made by me. i go into the branch to inquire and i found out that another party (a well-known meat/fish shop in white rock) was writing cheques against MY BANK ACCOUNT! cibc hasn’t changed at all. . .
. . .AND. . .as far as the fine print is concerned, i’ll tell you right now, doesn’t mean shit to the financial services industry. they’ll rip up and ignore contracts, agreements and court orders if it suits them. . .beware the lawless banking industry of canada. . .

that contact is void. it does not have a monthly repayment date.
it has a yearly anniversary of Dec 2 (2000) but was finalized midmonth October 1999.
therefore RBC violated the contract as stated by demanding monthly repayments.
it can only demand the approx. $14 K annual repayment, not monthly repayments.
therefore it owes Mr Fraser for the boat (current value), house (at current market value) and equipment.
in essence, RBC made Fraser homeless and removed him from the comforts of middle class life, thrusting him into poverty.
this is not surprising since basically it was the mistake of a rich person i.e. the loans officer who neglected to put a monthly anniversary date on the contract!!!

As I stated before, credit unions are more responsible to the customer. I haven’t been to a bank since my student loan came due in 2002.
IMO CIBC screwed me around regarding the loan because they waited until the 6 month period after a school course is finished before sending the dogs after me.
There was no reminder, apart from the usual you get when the bank notes the anniversary date and honors the 6 month waiver period.
I could be ready to repay in about 3-6 months but would rather see how good their sleuthing is.
Thank you Jr. and Sr. for your stories and advice. My problems are tiny compering to yours, but still my blood is boiling. I will describe my current problems later. I have another sample of RBC bullying, and how they treat the 20-years long customer:
Everybody knows, that when loan payment date happens to be on a weekend or holiday, it will be processed the next bussiness day. Not at RBC. Last Labor Day - 1st of September (National Holiday) happened to be on Monday. This is also a pay day of my car loan. To be sure that there are sufficient funds in my account I transferred from my RBC line of credit money a day before - on Sunday, August 31. RBC recorded transfer with 2-days later date - 2nd of Sept. - the first bussiness day after the long weekend. That’s OK. Imagine my surprise, when I’ve found on Tuesday, that RBC processed my auto loan payment with the date of 1st Sept (Labor Day). At least they tried, but there was no funds, so they hit me with $40 not sufficient funds fee. I contacted the holder of my auto loan, where I’ve learned that nobody processes any payments on holiday and nobody collects any penalties. That this is an invention of RBC, just to collect $40. So, RBC cannot process on weekend any funds transfer from RBC line of credit to RBC account, but they can initiate payment to third party in the middle of the weekend. I am very financially responsible person. I have excellent beacon score. But it doesn’t protect me from problems. Right now, my RBC account is “restricted”. Reason - I have deposited President Choice’s check, which was rejected for unknown reason. (I am waiting for unswers) My President Choice account is in perfect condition, check was original, received from PC as “conveniance” check. For one day my balance at RBC was -$4000 - it is a reason of restriction. I immediatelly (next day) transfered funds to “restricted” account to fix a problem. Now, because of “restricted” account, my mortgage, and other bills were not payed, despite a positive balance of $1500, which I have no access to. I will dump RBC, as soon as possible. I think I will try credit union, as per Sr.‘s advice.

. . . your abuse at the hands of royal bank is consitent with my experience with banks in british columbia. i’ve just been hit with another unlawful seizure in the amount of a painful $61,000.00 i held in a cibc gic term deposit in powell river, bc. the branch manager waited patiently from my investment to mature, then when the annual interest payment was remitted and the locked-in investment became available for redemption the branch manager redeemed my privately-owned investment himself and deposited the funds in a cibc bank account. on top of that the bank attempted to conceal the theft. it took me two months of badgering cibc to finally get some disclosure from them about what happened to my money. and to this day cibc has not yet remitted any legal paperwork that justifies the confiscation of my funds. it’s theft plain and simple. i’ll write up an account of cibc’s unlawful seizure of my cash along with some other very bizarre incidents that have occurred over the past couple of months with an update on my website this week . . .
Many of us are going through the same abuse and victimization. Our governments both the Liberals and PC`s will not hold the banks accountable. If you try to ask the bank why is your monies missing, they laugh. They will never tell you or find your missing money. They order you to pay the fraudulent loans. There is no government or policing authority assigned by our government to help us. The banks are above the law. Lies, lies, lies and more lies… The case of the banker who got arrested at CIBC dartmouth branch, Sunday Edokpayi, a native from Nigeria, who sold clients financial information from that branch to know Nigerian411 ers in Toronto, is still a mystery to me as to why just house arrest. He was arrested in 2007 summer. It seems there is a very well organized group in Nova Scotia, and it seems in each of these group, the nucleus is a financier. THIS CAN ONLY CHANGE WHEN WE VOTE OUT THE LIBERALS AND PC`S. They protect the banks.

Former employee at CIBC charged with account tampering

A former employee at a CIBC branch in Dartmouth has been charged with tampering with customers’ accounts last year.
Sunday Edokpayi, 48, of Dartmouth was arraigned Tuesday on 32 charges and he returns to court in September.
Police allege that account information was passed on to people in the Toronto area, who then applied for and used CIBC Visa cards in the names of unsuspecting customers. Edokpayi faces 15 counts of trafficking in credit card data, 15 of fraudulently obtaining CIBC customer data, and single counts of conspiring with persons known to traffic in credit card data and defrauding the bank of more than $5,000.
The offences are alleged to have occurred between Jan. 1 and April 24, 2007.
Edokpayi is a native of Nigeria who now has Canadian citizenship.
