Also in many jurisdictions, the government/state will pursue criminal charges regardless of what the victim desires. Exactly. I have seen cases where the man in the situation has been physically abused, the woman was not, yet it was the man that was arrested. After having spent the night in jail, he gets dragged in front of a judge and has a restraining order put on him. He is allowed no contact with the woman and has to have a police escort to enter the home to pick up a few clothes and personal items. The woman feels remorseful and wants the restraining order lifted, and is told no it will not be lifted. The police officer explains that although he doesn't necessarily agree with what has happened in this circumstance, the order must be upheld. Although there was no evidence for criminal charges, the restraining order was in place for months after. |

So your telling me when the cops show up and see hes bleeding and theres no marks on the female there going to take him? OMFG your retarded. You REALLY need to learn some law about domestic violence. My Sisters Husband is a cop and he tells me all sorts of stories like this so i know what im talking about. BTW, you are correct about the domestic violence law. Physical injury isn't a prerequisite to an arrest. If the police arrive someone will be arrested and they tend to arrest the male. What if his girlfriend tells the police that he choked her or locked her in the house. As a result, she punched him in self defense or because she felt "threatened" there would be harm to her? This guy would be arrested. Sometimes its much easier for a woman to twist facts and be convincing. In my opinion the domestic violence laws are required for some serious abuse cases, but some times serve to employ an industry of social workers, clinics and law firms. In the US, you lose your privilege to operate a firearm even if convicted of a misdemeanor. |

If the cops come, someone or both parties are arrested and will spend the next 30 hours in jail no matter what (or as long as someone says they felt pain and the police separate both parties during questioning). A protective order may also be issued baring you from contact and proximity to the victim even if they live with you. In almost all of these situations the male is arrested. Its usually the unwritten police policy. If your in that situation my advice is to is calm down and walk away. If she continues this behavior or threatens police, secretly plan your escape and get out the relationship. If you think there may be a problem, make sure you have witnesses present for you departure. A domestic violence charge is very serious, very expensive to defend (four to maybe ten thousand dollars) and has many consequences if you are found guilty. Getting caught for shoplifting or theft is far less serious. |
